Even prior to the introduction of the centre-piece of the current competition law (the Antimonopoly Law (AML)), King & Wood had undertaken many successful antirust reviews for M&A projects. In China, the timing of such approvals critically relates to the time at which a fully compliant filing is received by MOFCOM and deep experience is required to ensure that the filing is accepted without delay.
King & Wood has taken an active part in the drafting of Chinese anti-trust laws and offered recommendations on legislation and we have expanded our practice to include cartel defense work, (including leniency filings), and private litigation concerning breaches of the AML. As such, we have established good working relationships with such administrative agencies as the Office of Legislative Affairs of the State Council, the National Development and Reform Commission, and the Ministry of Industry and Commerce among others. This enables us to keep abreast of changes and developments in Chinese laws and policies and to fully assist our clients in communicating with administrative agencies.
