Bankruptcy, Liquidation & Reconciliation
Our Bankruptcy, Restructuring & Liquidation Practice offers our clients consultations on all aspects of the PRC Bankruptcy Law and on bankruptcy proceedings. Where we represent clients seeking liquidation of a business as a creditor (forced), or as a debtor (voluntarily), we prepare bankruptcy petition materials, draft bankruptcy petition documents, and submit them to the court on behalf of petitioners. We also offer pre-emptive consultations for clients facing potential cash-flow issues or those seeking to establish claims over distressed assets.
We regularly represent creditors in making claims and exercise related rights on their behalf, including acting as Chairman of creditors meetings at the request of the courts. We file recall rights requests for debtors and challenge applications on behalf of creditors, filing applications for leave to appeal on behalf of both. We also work as bankruptcy agents on behalf of the courts. We can also act to instigate voluntary liquidations for clients wishing to liquidate non-bankrupt entities.
We help our clients to carry out reconciliation applications to settle with creditors or debtors and we carry out detailed bankruptcy planning to assess the details of a debtor’s potential bankruptcy.
